There is no court specialised to handle procurement cases exclusively. Judicial review proceedings generally commence in the High Court. Application to correct alleged infringement or prevent damage to the applicant’s interests or for review of the contract award decision must be made within 30 calendar days after notification of decision, or knowledge of the alleged infringement. Where the application is for a declaration of ineffectiveness, this must be made within 6 months after the conclusion of the relevant contract. However, where a contract award notice has been published, the time limit for commencing proceedings seeking a declaration of ineffectiveness is reduced to 30 days, beginning on the day after the notice is published in the OJEU. Similarly, where the authority notifies candidates or tenderers of the outcome of the tender process and includes a summary of the reasons for the candidate’s or tenderer’s rejection, the period for commencing proceedings is 30 days beginning on the day after the authority has provided the notice. The courts do have discretion to extend the statutory time limits for making an application where the court considers there is good reason to do so. Date of dispatch of this notice : 2021-03-03 |
